How to improve the current regulation of cookies while browsing? The Privacy Guarantor asked this question in order to determine how and if it is possible to guarantee a true "grounding" of the principles underlying the Cookie Law, without obstacles that undermine the very nature of the legislation.

Rethinking cookies

Over time, in fact, quite a few distortions have emerged that have made the click for the acceptance of cookies a sort of tinsel to be paid during navigation, without however offering an authentic awareness to users who simply accept everything in order to continue in the service. What was a worthwhile initiative, in short, risks being extinguished day after day, click after click, scroll after scroll, in something that annoys and does not inform, mere formality where one hoped for a substantial step forward.

Il Guarantor therefore opens a public consultation "aimed at entrepreneurs, consumers and operators" with the aim of "acquiring observations and proposals" on the indications contained in the Guidelines of May 4, 2020, the purpose of which was to integrate the interventions of 2014 and 2015 .

The Guidelines contain, among other things, some indications relating to "passive" tracking systems (such as fingerprinting), to "scrolling", to the reiteration of requests for consent to users, to third parties.
